1. Agreement to Terms

3. SMS/Text Messaging Terms

Frenchy Web LLC may send SMS/text messages to customers and prospects who opt in to receive communications from us.

SMS messages may include appointment reminders, onboarding updates, service-related updates, customer support messages, review request reminders, missed-call follow-ups, account notifications, and promotional or marketing messages when separately consented to.

The following details apply to our SMS program:

• You must be at least 18 years old to opt in to receive SMS/text messages from Frenchy Web LLC.
• By opting in, you confirm that you are the owner or authorized user of the mobile phone number provided.
• Message frequency may vary depending on your inquiry, appointment activity, active projects, service requests, and communication preferences.
• Message and data rates may apply.
• Consent to receive text messages is not a condition of purchase for any service.
• Reply STOP at any time to opt out of SMS messages.
• Reply HELP to receive help details.

• After replying STOP, you may receive one final confirmation message, and you will no longer receive SMS messages from Frenchy Web LLC unless you opt in again.
• Carriers are not liable for delayed or undelivered messages.

• Monthly service plans renew automatically on a month-to-month basis until canceled.
• Payment terms, invoicing schedules, and payment methods are specified on your individual invoice or agreement.
• Late or failed payments may result in temporary suspension or termination of active services, software access, and support.
• Monthly services may be canceled at any time. Cancellation stops future billing but does not automatically refund previous payments, except as described in the 30-Day Satisfaction Guarantee.

7. No Guarantee of Results

While Frenchy Web LLC works diligently to build systems that improve your online growth, customer reviews, follow-up automations, and digital communication, we do not guarantee specific numbers of Google reviews, leads generated, customers acquired, revenue increases, search engine rankings, sales metrics, or overall business results.

Business performance depends on multiple external factors, including market demand, local competition, customer service quality, and client-side execution.

8. Third-Party Platforms

To deliver our services, we may configure, connect with, or utilize third-party platforms, which may include:

• Google Business Profile and Google Maps APIs
• CRM (Customer Relationship Management) and automation systems
• SMS, telephony, and VoIP carriers
• Email delivery services
• Website hosting and domain registration platforms
• Web analytics and conversion tracking software
• Advertising networks (such as Google Ads and Meta Ads)
• Payment processing systems (such as Stripe)
• AI language models and conversational assistant frameworks
• Online scheduling and calendar platforms

Frenchy Web LLC is not responsible for outages, service interruptions, policy updates, account suspensions, pricing increases, data losses, or administrative decisions made by any third-party platform.

9. Website Tracking and Third-Party Tools

We use third-party software tools for website analytics, advertising tracking, CRM integration, automation workflows, payment processing, booking calendars, phone/SMS services, and AI assistant support.

These tools assist us in operating our website, responding to inquiries, measuring the effectiveness of our campaigns, delivering service features, and supporting clients.

Frenchy Web LLC is not responsible for the privacy policies, service disruptions, technical bugs, or carrier issues associated with these third-party platforms.

10. 24/7 Assistant and Automation Disclaimer

AI assistants, automated text-backs, and communication automations are designed to help answer common questions, collect customer information, organize scheduling, and support workflows. While we test and configure these systems for accuracy, they are not human and may occasionally generate inaccurate, incomplete, or inappropriate responses.

Clients are responsible for monitoring their automated communications, reviewing AI assistant settings, and making final business decisions. Frenchy Web LLC does not guarantee that AI-generated responses will always be correct, appropriate, or complete.

11. Client Responsibilities

Clients working with Frenchy Web LLC are responsible for:

• Providing accurate business information, contact details, and marketing guidelines.
• Reviewing SMS templates, automated replies, email copy, and AI configurations.
• Complying with TCPA, A2P 10DLC registration, and local laws regarding customer outreach within their own business.
• Maintaining administrative access and ownership of their business accounts when required.
• Providing timely feedback, approvals, and assets needed to complete project milestones.

12. Intellectual Property

Unless otherwise agreed in a written contract, all website code, templates, graphics, written copy, workflows, custom automations, and proprietary materials created by Frenchy Web LLC are the intellectual property of Frenchy Web LLC and are protected by copyright and intellectual property laws.

Client-provided logos, photos, branding materials, existing web copy, and business accounts remain the sole property of the client.

Ownership or licensing rights to specific deliverables (such as a custom website or dashboard configuration) will be defined in your separate agreement, project proposal, or invoice terms.

13. Website Use

You may not use our website to copy our layouts, text, code, or branding for competitive purposes. You agree not to abuse, hack, scrap, overload, or attempt to disrupt the performance of our website.

14. Limitation of Liability

To the fullest extent permitted by law, Frenchy Web LLC and its owners, employees, or contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, loss of revenue, loss of business data, loss of Google reviews, missed sales leads, business interruptions, reputation damage, or loss of goodwill, arising out of or in connection with the use of our website, communication systems, automations, or services.

15. Indemnification

You agree to defend, indemnify, and hold harmless Frenchy Web LLC and its owners, officers, and contractors from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney's fees) arising out of your misuse of our website or services, your violation of these Terms, any inaccurate information you provide, your violation of TCPA/A2P 10DLC regulations, or your violation of third-party platform policies.

16. Governing Law

These Terms & Conditions, and any disputes arising from or relating to them, shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

17. Changes to Terms
